To ensure that consumers of behind-the-meter electricity services have adequate customer protections, Energy Policy WA is proposing that the Electricity Industry Act 2004 be amended to allow a customised approach to the regulation of prescribed categories of ‘alternative electricity service’ in the form of codes of practice, along with provisions for compliance and enforcement, and a mechanism for resolving disputes between service providers and consumers. In the first instance, it is proposed that a code of practice will be developed for behind-the-meter generation and storage service providers (BTM Code).
Energy Policy WA is scheduled to provide the Minister for Energy with a final recommendations report outlining the detailed arrangements and implementation requirements for the alternative regulatory framework in April 2020. This report will be accompanied by a draft BTM Code.
A working group of stakeholders (BTM Code Working Group) has been convened to assist development of the draft BTM Code with detailed stakeholder consultation on the draft BTM Code to occur as part of the process for development of the alternative regulatory framework.
BTM Code Working Group
The BTM Code Working Group is to provide technical, industry and consumer advice in developing a fit-for-purpose BTM Code and will include representation from industry and consumer groups.
The BTM Code Working Group is to function as an advisory body, not a decision-making body, and a consensus opinion will not be required. Members will be requested to offer views that represent their industry perspective, rather than individual organisational interests.
The role and purpose of the BTM Code Working Group are outlined in its Terms of Reference.
